Terms of Service

1. Overview

These Terms of Service govern your access to and use of Shardmonics, including the dashboard, studio, score analysis features, AI-assisted feedback features, help pages, and any related websites, APIs, or paid subscriptions, community features, sharing links, and embeds that reference these Terms (collectively, the "Service"). By creating an account, purchasing a subscription, or using the Service, you agree to be bound by these Terms.

2. Eligibility and Accounts

1. 1You must provide accurate registration information and keep it up to date.
2. 2You are responsible for maintaining the confidentiality of your login credentials and for activity that occurs under your account.
3. 3If you use Google or another third-party sign-in method, your use of that method is also subject to the third party's terms and policies.
4. 4If you are under the age at which parental or guardian consent is required under applicable law, you must obtain that consent before using the Service.

3. What the Service Does

Shardmonics is a music technology service designed to help users upload, organize, display, and analyze scores. Depending on your plan and settings, the Service may provide:

• Project creation, organization, and score management
• MusicXML upload, storage, rendering, and viewing tools
• Harmony analysis, playability/orchestration analysis, and related visualizations
• AI-assisted feedback and explanatory assistance
• Community questions, answers, playability ratings, accepted results, reports, and reputation scores
• Share links, embed code, and Open Graph metadata for social previews
• User settings, saved preferences, and model-improvement consent controls

4. User Content and Your Rights

1. 1You retain ownership of the scores, project materials, text, feedback, and other content that you upload or submit to the Service ("User Content").
2. 2You represent and warrant that you have the rights, permissions, and legal authority necessary to upload, process, and use the User Content through the Service.
3. 3You are responsible for ensuring that your uploads do not infringe third-party copyright, moral rights, privacy rights, publicity rights, contract rights, or other rights.

Public community questions, comments, display names, accepted-result status, reputation scores, and score preview images may be visible to other users and may appear in share links, embeds, and social previews.

5. License You Grant to Shardmonics

To operate the Service, you grant Shardmonics a limited, non-exclusive, revocable license to host, copy, process, transmit, analyze, display, and otherwise use your User Content solely as needed to:

• Provide the Service features you request
• Store and sync projects across sessions and devices
• Generate score analysis, AI-assisted responses, and related outputs
• Display public community posts, comments, attached ratings, share links, embeds, and Open Graph previews
• Maintain security, prevent abuse, and troubleshoot service issues

Shardmonics does not use your uploaded scores or feedback to train or improve internal models unless you have separately opted in through an explicit training or improvement consent flow. Community ratings, accepted results, reports, and quality signals that you intentionally submit may be managed for service-quality review and model-improvement candidate queues where permitted by consent or applicable law.

6. Acceptable Use

You may not use the Service to:

• Upload or distribute infringing, unlawful, abusive, or fraudulent material
• Reverse engineer, bypass, scrape, or interfere with the Service or its security controls
• Upload malware, harmful code, or content intended to disrupt the Service
• Exploit the Service to build competing datasets or services in violation of applicable law
• Impersonate another person or misrepresent your affiliation or authority
• Manipulate or automate community reputation scores, accepted results, reports, or rating features

7. Paid Plans, Billing, and Cancellation

1. 1Certain features may require a paid subscription. Current plan details, prices, and billing cycles are presented in the Service at the time of purchase.
2. 2Paid subscriptions are processed through Paddle and may renew automatically unless you cancel before the next billing date.
3. 3You authorize Shardmonics and its payment processor to charge the selected payment method for recurring fees, taxes, and other charges disclosed during checkout.
4. 4You may cancel through the Service settings, the applicable billing portal, or another method made available by Shardmonics. Unless stated otherwise at checkout, cancellation takes effect at the end of the current billing period.
5. 5Shardmonics may change prices or plan terms prospectively. If a material pricing change applies to your subscription, Shardmonics will provide prior notice within the Service, by email, or by another reasonable method before the change takes effect.

8. Refunds and Withdrawal

Refunds, withdrawal requests, and billing disputes are handled subject to applicable law, these Terms, the billing flow presented at purchase, and the policies of the relevant payment processor.

• Where Korean consumer protection laws or other mandatory local laws grant you withdrawal or refund rights, those rights are not limited by these Terms.
• Because the Service includes digital content and on-demand analysis features that may begin immediately after purchase or use, withdrawal or refund rights may be limited to the extent permitted by applicable law once the digital service has started or has been substantially consumed.

9. AI and Analysis Outputs

• You remain responsible for your own musical, editorial, legal, and commercial decisions.
• Shardmonics does not guarantee that any analysis or suggestion is error-free or fit for a specific purpose.
• Community scores and accepted-result counts are in-service reputation indicators and do not represent monetary value or professional credentials.

10. Service Availability, Changes, and Beta Features

1. 1Shardmonics may change, suspend, or discontinue any part of the Service, including features in beta, preview, or experimental status.
2. 2The Service may be temporarily unavailable due to maintenance, security updates, infrastructure issues, or events outside Shardmonics's reasonable control.
3. 3Shardmonics is not obligated to maintain any particular feature set, compatibility, or service level unless a separate written agreement expressly states otherwise.

11. Suspension and Termination

• You may stop using the Service at any time and may request account deletion through the Service settings.
• Shardmonics may suspend or terminate access if you materially violate these Terms, create legal or security risk, fail to pay required fees, or misuse the Service.
• Where reasonable, Shardmonics may provide notice and an opportunity to cure before permanent termination, but Shardmonics may act immediately when necessary for security, legal compliance, or abuse prevention.

12. Limitation of Liability

To the maximum extent permitted by applicable law:

• The Service is provided on an "as is" and "as available" basis without warranties except as required by law.
• Shardmonics is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, goodwill, data, or business opportunity.
• Shardmonics is not responsible for losses caused by your own uploads, your failure to back up materials, third-party services, or your use of the analysis or AI outputs as definitive advice.
• If liability cannot be excluded, Shardmonics's aggregate liability will be limited to the amount you paid to Shardmonics for the relevant paid service during the 12 months preceding the event giving rise to the claim, except where a higher minimum standard applies under mandatory law.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Korea unless a different law applies mandatorily under consumer protection or other non-waivable legal rules. Any dispute arising from or relating to these Terms or the Service will be resolved by the court with jurisdiction under applicable law.

Nothing in these Terms limits non-waivable rights you may have under applicable consumer protection, electronic commerce, or privacy laws.

14. Changes to These Terms

Shardmonics may update these Terms to reflect changes in law, payments, service functionality, risk controls, or operational needs. If the changes materially affect your rights or obligations, Shardmonics will provide reasonable advance notice. Your continued use of the Service after the effective date of the updated Terms means you accept the revised Terms.
